Is Smoking Ban Not Constitutional

Approximately 80% of population from Michigan does not smoke, because of the new smoke free act which was approved in May. The new legislation prohibited the cigarettes smoking at restaurants and bars.
But State Legion declared that taking their cigarettes means that is taking their freedom and their real pleasure of enjoying the taste of their favorite smoking brand.
"Smoking is a legal habit. Doesn’t matter, like it or not, tobacco is not heroin and should be allowed as a legal activity and to ban it even on private property, we consider that it is not constitutional," argued Legion member Joseph O'Leary.
This is the main cause why most of inhabitants ignore it. Workers continue to smoke at their working places and in the public places. And they will never accept the new anti-smoking law because they consider that it cut their freedom.
"They are capturing too many rights away in our days and the more they take away, the more they get away with it," declared Legion member Paul Adams.
"They are just removing away at so many things that we are not going to respect America in a new generation," added also Legion member Michael Mleko.
In reply, the health department has emitted them a notice and they are turning out of abstinence.
"We all respect their right to defiance it. However, I’m not agreed that this special anti-smoking law found it favorable place. I think also that the new legislation can have positive effects for everybody," declared health officer Guy St. Germain.
But the health department is taking it a step further because the Legion refuses to implement the new smoking ban. This is why they have ordered the Legion to stop providing food and beverage.
The Legion has also refused that order and they will continue it action for to make smoking again legal in their state. But the health department decided to put all smoking products out only to protect the inhabitants’ health.
Researchers concluded that majority of inhabitants accepted the smoking ban and they even quitted smoking and became very happy.
